DEMING – The Luna County Board of County Commissioners will consider a proposed third amendment to Ordinance 53 during its regular meeting Thursday, Oct. 8, at 2 p.m. in the Commission Chambers at the Luna County Courthouse.
Ordinance 53 regulates the placement and permitting of wireless telecommunications facilities in Luna County.
The proposed amendment would update requirements concerning legal access to proposed facility sites, responsibility for performance bonds and the time allowed for reviewing and deciding applications under federal law.
Additional changes would update definitions, engineering standards, exemptions for federal land and notification procedures for property owners. The amendment would also clarify the administrative review process for small wireless facilities and eligible facility requests.
Other proposed revisions include corrections to statutory citations, enforcement provisions and administrative and technical language.
If approved and recorded, the amendment would take effect 30 days later.
Copies of the proposed amendment will be available at the Luna County Clerk’s Office and the Luna County Manager’s Office inside the Luna County Courthouse, 700 South Silver Street in Deming.
